SizeFit Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SizeFit: Size Chart & Fit Finder Shopify application and related services ("SizeFit", "the app", "the Service"). SizeFit is operated by Raphael Mun, operating as Instafluff ("we", "us", "our"). By installing or using SizeFit, you ("you", "the merchant") agree to these Terms. If you do not agree, do not install or use the app.

1. The Service

SizeFit is a third-party Shopify app that lets apparel, footwear, and accessory merchants:

  • Build and assign size charts (per product, collection, tag, or store-wide; from templates or CSV import; with cm/inch switching).
  • Offer shoppers a deterministic, rule-based Fit Finder that recommends a size from a shopper's anonymous, session-only measurements.
  • View an estimated returns-avoided analytics dashboard.
  • Export their charts and rules (CSV/JSON) with one click.

SizeFit is not affiliated with, endorsed by, or operated by Shopify. Your use of Shopify is governed by Shopify's own terms.

2. Eligibility and account

To use SizeFit you must have an active Shopify store and the authority to install apps and bind that store to these Terms. You are responsible for your Shopify account, your staff's use of the app, and keeping your store and contact details accurate.

3. Plans, billing, and trials

  • SizeFit offers a Free plan and a Pro plan ($14/month at the time of writing, with a 14-day free trial). Current features and prices are described in the Shopify App Store listing and in the app.
  • The Free plan is always available as a floor: a billing gap will not hide your existing size charts from shoppers. Paid features (such as the Fit Finder, returns-avoided analytics, and watermark removal) are gated to the Pro plan.
  • All charges are processed through the Shopify Billing API and billed via your Shopify account under Shopify's billing terms. We do not collect or store your payment-card details.
  • Price and plan changes. We may change prices, plans, or feature gating. We will provide notice as required by Shopify and applicable law; changes apply on a going-forward basis.
  • Trials convert to paid at the stated price unless cancelled before the trial ends, per the Shopify Billing flow.
  • Except where required by law or expressly stated, fees are non-refundable. You can cancel at any time by downgrading or uninstalling; cancellation stops future charges and takes effect per the Shopify Billing cycle.

4. Your content and data

  • Your content. Size charts, assignments, rules, imported CSV data, and configuration you create ("Merchant Content") remain yours. You grant us a limited license to host, process, and display Merchant Content solely to provide the Service to you.
  • Accuracy and responsibility. You are responsible for the accuracy of your size charts and fit rules. SizeFit renders and applies the data and logic you configure; it does not independently verify that your measurements or recommendations are correct for your products.
  • Export and portability. You can export your charts and rules at any time (CSV/JSON), including on the Free plan.
  • Privacy. Our handling of data is described in the SizeFit Privacy Policy. SizeFit stores no shopper personal data; the Fit Finder uses anonymous, session-only measurements.

5. Acceptable use

You agree not to:

  • Use SizeFit to violate any law or any third party's rights, or in violation of Shopify's terms and API/Partner Program requirements.
  • Reverse engineer, decompile, or attempt to extract source code, except where such restriction is prohibited by law.
  • Probe, scan, overload, disrupt, or circumvent the security or access controls of the Service, or attempt to access another merchant's data.
  • Resell, sublicense, or provide the Service to third parties except your own store operations.
  • Misuse the app to collect personal data from shoppers in a way that violates applicable privacy law (the app is designed not to collect shopper PII; do not attempt to repurpose it to do so).

We may suspend or terminate access for violations of this section.

6. The estimated returns-avoided analytics — important disclaimer

SizeFit's returns-avoided dashboard provides an ESTIMATE, not a guaranteed or audited financial figure. The estimate is computed from anonymous fit-finder engagement combined with inputs you supply (such as average order value and a baseline return rate) and stated assumptions. Actual returns, savings, conversion, and revenue outcomes will vary and depend on factors outside SizeFit's control, including your products, pricing, traffic, the accuracy of your charts and rules, and shopper behavior. We make no guarantee of any specific reduction in returns, increase in conversion, or financial result. You should not rely on these estimates as accounting, tax, or financial advice.

7. Intellectual property

SizeFit, including its software, design, branding, templates, and documentation, is owned by the operator and protected by intellectual-property laws. Except for the rights expressly granted to use the Service, no rights are transferred to you. The "SizeFit" and "Instafluff" names and logos may not be used without permission. Feedback you provide may be used to improve the Service without obligation to you.

8. Third-party services

The Service depends on third parties including Shopify (platform, authentication, billing, catalog data) and Microsoft Azure (hosting and storage). Your use of those services is subject to their respective terms. We are not responsible for the acts, omissions, availability, or terms of third-party providers.

9. Service availability and changes

We aim to keep SizeFit available and reliable but provide it on an "as is" and "as available" basis. We may modify, add, or remove features; perform maintenance; or set reasonable usage limits to protect the Service. We are not liable for downtime, data delays, or changes, except as required by law.

10. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SIZE RECOMMENDATIONS OR ANALYTICS WILL BE ACCURATE OR ACHIEVE ANY PARTICULAR RESULT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR SIZEFIT IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless the operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Merchant Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right (including the rights of your shoppers).

13. Termination

  • By you. You may stop using SizeFit at any time by uninstalling it from your Shopify admin. Uninstalling stops future charges (per the Shopify Billing cycle) and triggers data deletion via Shopify's shop/redact flow, as described in the Privacy Policy.
  • By us. We may suspend or terminate your access if you breach these Terms, misuse the Service, or as required to protect the Service, other merchants, or shoppers.
  • Effect. On termination, your right to use the Service ends. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Washington, without regard to conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in that jurisdiction, and you consent to that venue, except where applicable law grants you non-waivable rights to a different forum. Nothing here limits mandatory consumer or data-protection rights you may have under your local law.

15. Changes to these Terms

We may update these Terms as the Service or the law evolves. When we do, we will revise the "Last updated" date above and post the new version at the Terms' published URL. Material changes take effect when posted; your continued use of SizeFit after an update constitutes acceptance of the revised Terms.
